Terms of Service

These Terms of Service ('Terms') govern your access to and use of the Estaty platform and related services ('Service') provided by Estaty ('we', 'us', or 'our'). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and have the legal capacity to enter a binding contract to use Estaty. By using the Service, you represent that you meet these requirements. The Service is intended for professional use by real estate agents, brokers, and property consultants.

2. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at hello@estaty.io if you suspect unauthorised access to your account.
• You may not share your account or allow others to access it on your behalf.

3. Subscription and Payment

Free trial

New accounts receive a 30-day free trial of the Pro plan. No credit card is required to start. At the end of the trial, your account reverts to a limited free tier unless you subscribe.

Pro subscription

• Subscriptions are billed monthly in advance.
• Payment is processed securely by Lemon Squeezy. By subscribing, you agree to Lemon Squeezy's terms of service.
• You authorise us to charge your payment method on a recurring monthly basis.
• Prices are displayed in USD and are exclusive of any applicable taxes. You are responsible for paying any applicable taxes.

Cancellation and refunds

• You may cancel your subscription at any time from the Subscription page.
• Cancellation takes effect at the end of the current billing period. You retain Pro access until then.
• We do not offer refunds for partial billing periods, except where required by applicable law.

4. Acceptable Use

You agree not to use the Service to:

• Post false, misleading, or fraudulent property listings.
• Violate any applicable law, regulation, or third-party rights.
• Upload content that is defamatory, obscene, or infringes intellectual property rights.
• Attempt to gain unauthorised access to the Service or its related systems.
• Scrape, crawl, or extract data from the platform by automated means.
• Use the Service to send unsolicited commercial messages (spam).
• Interfere with or disrupt the Service or its servers.
• Impersonate any person or entity.

We reserve the right to suspend or terminate accounts that violate these rules without notice.

5. Your Content

You retain ownership of all content you upload to Estaty, including listing photos, descriptions, and profile information ('Your Content'). By uploading Your Content, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and process it solely to provide the Service.

You are solely responsible for Your Content and represent that you have all necessary rights to it. We do not claim ownership of Your Content and will not use it for any purpose beyond operating the Service.

6. Intellectual Property

The Estaty platform, including its software, design, trademarks, and all content we create, is owned by Estaty and protected by intellectual property laws. These Terms do not grant you any right to use our brand, logo, or other intellectual property outside of using the Service.

7. Third-Party Services

The Service integrates with third-party providers including Supabase (database), Vercel (hosting), Lemon Squeezy (payments), and Resend (email). Your use of third-party services is subject to their respective terms and policies. We are not responsible for the actions or content of third-party services.

8. Disclaimers

THE SERVICE IS PROVIDED 'AS IS' AND 'AS AVAILABLE' WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ESTATY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Estaty and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and costs (including legal fees) arising from: (a) your use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time for cause, including violation of these Terms, with or without notice. You may delete your account at any time from Settings. Upon termination, your right to use the Service ceases immediately. We will delete your data in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice in the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
